The directive was issued while hearing a petition filed by assistant teacher Sitakanta Samal, and also seeks clarity on vacant teaching posts and the steps being taken to fill them.</p>
<p data-start="566" data-end="1208"><strong data-start="566" data-end="615">Concerns Over Transfers Amid Teacher Shortage</strong><br data-start="615" data-end="618" />The division bench, headed by Justice Dikshit Krishna Shripad, expressed concern over allegations that teachers are being transferred from schools already struggling with staff shortages. The court noted that such practices violate transfer rules, which require teachers to complete a specified tenure before relocation. It further observed that improper transfers disrupt the STR, thereby harming the quality of education. Citing the New Education Policy of the Central Government and the book <em data-start="1113" data-end="1133">Golden Opportunity</em>, the court stressed the importance of maintaining educational standards.</p>
<p data-start="1210" data-end="1592"><strong data-start="1210" data-end="1254">Right to Education Cannot Be Compromised</strong><br data-start="1254" data-end="1257" />Drawing on a Supreme Court ruling that enshrines the right to education under Article 21 of the Constitution, the bench underscored that administrative lapses in ensuring adequate teaching staff cannot be overlooked. The court highlighted that a robust STR is crucial for delivering quality education and shaping the nation’s future.</p>
<p data-start="1594" data-end="2030"><strong data-start="1594" data-end="1632">Interim Stay on Teacher’s Transfer</strong><br data-start="1632" data-end="1635" />In a notable development, the High Court issued an interim stay on the transfer order of petitioner Sitakanta Samal, who had been moved on July 24, 2025, from Bapuji Government High School in Nishchintakoili block to Baunshpur Government High School in Banki block. Samal contended that the transfer was unreasonable and sought to remain at his current posting until the court’s final verdict.</p>
<p data-start="2032" data-end="2346"><strong data-start="2032" data-end="2062">Officials Asked to Respond</strong><br data-start="2062" data-end="2065" />The court has issued notices to the School and Mass Education Secretary, the Director of Elementary Education, the Cuttack District Education Officer, the Nishchintakoili Block Education Officer, and the headmaster of Bapuji High School, directing them to submit their responses.</p>
